Below are details of our Customer Service Contract, Delivery Policy, Privacy Policy and Cancellation/Return/Refund Policy .
Wedding Photography Services
In the following conditions of contract "the photographer" shall mean Allan Tannock trading as V&A Creative Moments.
"The client(s)" shall be those whose names appear on the contract. If the client(s) arrange for a third party to meet the costs of this contract the contract remains with the client(s).
1 Licence, Coverage and Reproduction:
a) The client(s) understands and accepts that the photographer shall be granted complete artistic licence in relation to the images photographed, the locations used and editing and the photographer's judgement shall be final.
b)Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all of the images requested. If planned timings for the day are running behind schedule this will affect the time available for photography and subsequently the images that can captured.
c) For a booking involving a church ceremony or at certain venues, photographing parts or all of the ceremony may be restricted and the photographer cannot accept responsibility for any obstructed view or reduction in coverage should this be the case.
d) In the event of rain, snow or any form of weather disturbance, the photographer will make the necessary changes to the photographic session but will not be responsible for reduction in coverage due to adverse weather.
e) The photographer will not be responsible for loss of images due to technical failure, either at the shooting or processing stage.
In the unlikely event of total photographic failure the photographer's liability shall be limited to a full refund of any fees paid.
f) The photographer or the designer shall be granted complete artistic licence in the building and production of album design.
2.Force Majeure:
a) The due performance of the contract is subject to alteration or cancellation by the photographer owing to any cause beyond their reasonable control (e.g. ill health/injury/victim of crime)
In the event of cancellation by the photographer the photographer's liability shall be limited to a full refund of any fees paid. Refund will be made by cheque within three (3) weeks of cancellation.
3. Copyright:
a) Digital files shall remain the property of V&A Creative Moments. Images included in this contract are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy any image created without the permission of the photographer in writing.
Clients who order any of the Digital Packages shall be given permission to print the images for their own personal, non- commercial use.
4. Display:
The client hereby allows V&A Creative Moments to display any images included in this contract in their studios, portfolios, literature, wedding exhibitions, websites and sample albums for the purpose of advertising, providing that the images are used lawfully.
5. Booking Fee and Cancellation:
A booking is confirmed on receipt of the completed booking form and signed Terms and Conditions together with the appropriate booking fee, which is non-refundable. The client may cancel this contract by giving written notice to the photographer but in doing so shall forfeit any monies paid. Should the client cancel the contract less than 112 days prior to the date of the event, the client shall in addition pay a sum equal to 75% of the contract value.
Payment for the photographic coverage is due in full NO LATER THAN 28 DAYS prior to the contracted date.
Non-receipt of the full balance by the due date will be deemed cancellation of the contract by the client.
6. Placing an Order and Receipt of Goods:
a) All standard photographic services specified on the Booking Form and paid for in full before the date of the event are supplied at prices ruling on the date of signing the contract. Optional extras such as re-prints, CDs, DVDs not paid for in full before the date of the event are supplied at pricing ruling at the time of receipt of the order.Due to the nature of the product V&A Creative Moments are unable to give exchanges or refunds. This does not affect your statutory rights. Images will be available approximately 3-4 weeks following the photography service.
Goods will either be delivered to the client or the client may arrange collection with V&A Creative Moments.
If circumstances warrant, goods may be posted to the client at additional expense determined when the order is placed.
b).Digital files including album design proofs shall be kept by V&A Creative Moments for not less than 12 months from the date of event. After 12 months all digital files and digital album proofs will be archived. Retrieval of archived files/album proofs will incur an admin fee of £50.
Albums ordered more than 6 months after the date of event will incur an admin fee of £30.
7. On the Day:
a) The photographer is contracted to shoot all photographs relating to the event and no other person is permitted to shoot images for sale or as gifts unless agreed in writing before the day. This includes guests (except for their own personal non-commercial use). Breach of this condition shall be deemed cancellation of the contract by the clients.Coverage may be cancelled without warning at the discretion of the photographer if the photographer or assistant feels threatened or has reason to believe that equipment may be damaged.
8. Complaints:
Complaints should be raised by the client in writing, within 21 days of the event and within 21 days of receipt of the images.
9. Smoking Policy:
In line with the Health and Safety Act 1974 V&A Creative Moments has a duty to provide a working environment for staff that is: "safe, without risks to health, and adequate as regards facilities and arrangements for their welfare at work". We therefore ask that you do everything possible to provide a smoke-free environment when we visit you in your home.
10. Privacy - Clients details will remain confidential. V&A Creative Moments will only hold Clients details for the purpose of business records and will not disclose such details to third parties.
Portrait Photographt Services.
1. Booking Fee:
All appointments are confirmed with a £30 non-refundable booking fee, which will be deducted from the full session fee.
Where makeup services are required, a further £20 non-refundable deposit is due, which will be deducted from the full fee.
Payment for the remainder of the session fee is required on the day of the photo shoot.
2. Cancellation:
Please be considerate and give as much notice as possible if you are unable to attend your session. In the event of cancellation of a pre-booked photo session, the deposit may be carried forward once only for an alternative date. If no suitable arrangement can be made or the appointment is cancelled a second time, the Client will forfeit their booking fee.
If V&A Creative Moments were to cancel the photography session, 100% of the booking fee paid will be refunded by cheque within three (3) weeks.
In the event of inclement weather or poor lighting conditions the Photographer will reschedule outdoor sessions for the earliest mutually convenient time and date.
3. Payment/Refund:
Payment for photographs, albums, CD/DVDs etc must be made in full at the point of order. Cash, cheques or credit/debit card are accepted.
All photographic albums, box frames, canvas and acrylic printed products are produced to order and as such cannot be returned for a refund. This does not affect your statutory rights.
4. Delivery:
Images will be available to view approximately 3-4 weeks following the photography session.
Goods will either be delivered to the client or the client may arrange collection with V&A Creative Moments.
If circumstances warrant, goods may be posted to the client at additional expense determined when the order is placed.
5. Copyright:
V&A Creative Moments will retain copyright for all images produced and may not be copied photographically, electronically or by any other means unless written permission is given by V&A Creative Moments. Any images taken by the photographer (and material ordered) may then be used for advertising, competitions and marketing. However the photographer will not sell the Clients images to any third party without gaining the written permission of the Client.
6. Liability - The Photographer shall not be liable to the Client for any failure, in whole or in part, to fulfil his/her obligations under an order where failure arises as a result of an event or circumstances beyond his/her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.
7. Privacy - Clients details will remain confidential. V&A Creative Moments will only hold Clients details for the purpose of business records and will not disclose such details to third parties.
Make-up Artistry Services.
In the following conditions of contract "the make-up artist" shall mean Valerie Tannock trading as V&A Creative Moments.
"The client(s)" shall be those whose names appear on the contract
1. Booking Fee:
All appointments are confirmed with a non-refundable booking fee of £30 per person (up to a maximum of £90).
Following a makeup trial, a further non-refundable booking fee of £30 per person (up to a maximum of £90) will secure the wedding date.
Payment of the final and non-refundable balance is due 28 days prior to the wedding/special occasion date.
2. Contract:
Time booked will only reflect those services reserved on the contract and each service requires a certain length of time to be completed as advised on the booking form.
The desire to add additional people to a signed contract does not guarantee there will be time to include them if it conflicts with the day-of-event schedule, so when securing your date, please book accordingly.
If planned timings for the day are running behind schedule this will affect the time available for make-up artistry. The make-up artist therefore cannot guarantee that all clients on the booking form will be made-up for the event if clients arrive later than the agreed start time.
3. Cancellation:
If for any reason the client must cancel the booked event or any services on a contract, the booking fee paid will not be refunded but may be carried forward once and only if both parties can agree an alternative date.
If V&A Creative Moments were to cancel, 100% of the booking fee paid will be refunded by cheque within three (3) weeks.
4. Venue:
All trials and day-of-event services are conducted at the client's home or wedding venue.
There is no additional charge for locations within Lanarkshire.
Locations more than 20 miles outside of this radius will incur a travel fee and the amount will be determined at the time of booking.
5. Service Requirement:
A suitable counter or table with adequate space for the makeup kit to be set out is required. The room used should have ample lighting (whether by lamp or natural daylight).
6. Liability:
V&A Creative Moments is careful to ensure a high standard of cleanliness in working practice. Although every care is taken in the choice of cosmetics used, we will not be held liable in the event of an allergic reaction.
The client must advise V&A Creative Moments of any known allergies prior to confirming a booking.
7. Privacy: Clients' details will remain confidential. V&A Creative Moments will only hold Clients' details for the purpose of business records and will not disclose such details to third parties.
8. Health and Safety:
a) Smoking Policy.
In line with the Health and Safety Act 1974 V&A Creative Moments has a duty to provide a working environment for staff that is: "safe, without risks to health, and adequate as regards facilities and arrangements for their welfare at work" Second-hand smoke has been found by the Government Scientific Committee on Tobacco and Health to be detrimental to people's health.
We therefore ask if you would do everything possible to provide a smoke-free environment when we visit you in your home and when carrying out makeup services.
V&A Creative Moments reserves the right to withdraw services if a smoke free working environment cannot be provided.
b. Pets.
We respectfully request that pets such as cats and dogs are kept away from the working area and the area where make-up is set out.
c) Safe environment.
V&A Creative Moments reserves the right to withdraw services without warning if the make-up artist feels threatened, unsafe or has reason to believe that equipment may be damaged/contaminated.
